....and how will the nomination be handled? I assume, under the current Senate rules, the nominee will be confirmed with a simple majority which the democrates have - at least until the mid-term elections in November.

The upcoming elections are far too tight for Obama to put up the type of nominee that he'd really like to, so he'll wait. Don't discount Preet Bahara. Obama would not hesitate to elevate Bahara to take the heat off of Cuomo.

Preet has said he doesn't want the appointment and Deval Patrick has said so too . I'm not sure who else is on the " short list " right now but you can bet that whoever it is is an idealist with a communist attitude . From what I have herd the confirmation preceedings won't come until after the mid terms because as I said both of the top picks have said no ! Now whoever it is that takes the job after the midterms will be grilled beyond belief .

If Harry Reid's new Senate rules are in effect for a short time after the mid-terms, can't he jam a nominee through within a few dayz regardless of the election outcome?

Since the Senate rule change, democrats have been stacking the courts with liberals as soon as they are nominated. There are virtually no hearings; right? In effect, the GOP has NO say in the current nomination process. Apparently, this applies to all nominees except the Supremes; right?

If the GOP wins a majority in November, won't dear Harry change the rules back to require a 60 vote majority before the GOP majority is sworn in?
