I know it recommended and safer to ride in back but what's the law for riding up front. Found this link at DMV website. New York State's Occupant Restraint Law | New York State DMV. So the way I'm reading this, it would be legal for an 8 y/o that is 4'9" or taller or 100 lbs or heavier to ride in front seat with a seatbelt that has lap and shoulder harness? He would not be allowed to ride in center front seat with only a lap belt except if all other lap/shoulder harnesses in vehicle are being occupied by other children. He's getting to the age where he wants to ride up front and I want to throw him a bone for short trips around town. He's staying in the back when we are traveling on highway.

I thought the age/height/weights were only recommended. Before we found car seats that would let us put three across in the back, my daughter sat in front. Age 6; can't remember how tall or how many pounds. I sat in back - squeezed in the middle of the boys' car seats. We got pulled over for speeding one day, and the cop questioned her being in the front seat, but it wasn't a ticket-able offense.

I know the link I posted is not the actual legislation but I believe it is summarizing the law, not recommendations. I don't know for sure though which is why I'm asking the question.

What I was trying to say is that I'm pretty sure that in NY it isn't against the law to have your child in the front seat. Obviously, a baby should be in a car seat, but I don't think the state can prohibit a child from being in front. Some cars only have a front.


"All children must be restrained in an appropriate child restraint system while riding in a motor vehicle, until they reach their 8th birthday.
An appropriate child restraint system is one that meets the child's size and weight recommended by the manufacturer.
The safety belt in your vehicle is not designed for children. A booster seat raises your child up so that the safety belt fits your child correctly and provides better protection."

That's as far/as much as the law states.

But summary also states

"Exception: A child more than four feet nine inches tall or more than 100 pounds is allowed to use a seat belt that has both a lap belt and a shoulder harness."

What I'm trying to figure out is can he sit in front center of vehicle, which only has lap belt not lap and shoulder restraint. I know he can sit in front passenger seat which has both lap and shoulder harness.

If you were in the city of Rochester he could sit wherever the hell he'd like as no seat belt / child safety laws are followed at all in this city. It's craaazy the way people drive around here with uninsured cars and kids sitting on laps, etc

I believe this is okay for 8+. My understanding for younger kids is if there is an available lap/shoulder belt in the car not being used by other children, the law expects the child to be seated there (in a booster or car seat) instead of in a position that only has a lap belt.
