3) begin to scream
4) run around in circle
5) repeat steps 2 & 3 until you can no longer do step 4

a commenter on the article page said they'll have to throw out the evidence because it was technically an illegal search. I guess that probably comes down to whatever his lease said. Does a landlord have legal standing to enter apartments of rent deficient tenants?

NO they do not have the right. Unless the apt presents a hazard to the complex...say a water pipe burst, a fire, etc etc...

And they cant get hit with anything legally for breaking the lease/agreement, aside from a $$$ penalty that the land lord may push. Aside from that, the land lord can give the guy a 30 day notice...in reality it will take 2-3 months to get the tenant out..its a whole process.

Guys been arrested since December. Why didn't landlord evict him months ago?

There are plenty of ways around that. 24 hours notice is all that is required for an "inspection" such as smoke detectors, furnace filters, or preventative maintenance, real estate showing, etc. Of course if you have a mulit family and are doing a "routine inspection" notice should have been given to all units to make it look good.

It would be a shame if the guy was in jail and arrears in the rent the PM was "checking" the smoke detectors it was noted that someone broke in at some point and took anything of value from the premises. The only call would be to the police to report a probable break in. Multi units are not typically in the best of neighborhoods....

The only good thing about having a tenant in jail is you know they are going to show up in court. A judgement against the imprisioned is about worthless.

Whether he does or not is irrelevant, illegal search applies to law enforcement and since their search was legal it will stand up.

15 handguns, several shotguns and a couple thousand rounds of ammo requires the evacuation of 3 homes for several hours? oh wait i forgot, dangerous things like firearms randomly discharge by themselves on occasion, and a 9mm jhp will pass through 4 houses and a sherman tank before stoping.
