I had some arrests in 91. I have all the details and dispositions as I paid for an unsuppressed background check.
Here's where my question gets weird. So I knew I got in trouble in 1985. Me and a buddy painted a peace sign on a school and set it on fire. It was just a brick wall. Nothing else caught on fire.
Dumb yeah, but we were kids. Anyways. I reached out to the town as it wasn't listed on my unsuppressed report. Apparently they kept arrests on file on index cards back then. She was nice enough to go thru my records from back then 84 to 86 and she said she didn't find an arrest card.
So it was the 80s. I know my dad helped out a lot. But I don't remember anything of what happened with that back in the day.
My thoughts are to list it on the application, but I'm not sure exactly how I would list it as there's nothing on file.
So I was looking for a little help on how I should list it and why would it not be listed? Maybe they never arrested me? So I'm at a loss.
Don't want this be a determining factor of not being truthful. I currently own another gun and cleared the FBI check last year.

Thanks for the reply. It definitely was not a felony as I stated I purchased a gun last year. The 80s were different. Back then cops would escort drunks home, not arrest them all the time. That's why I'm wondering if my dad did something to keep it off the records.I would personally call the county where you will apply and ask them how to handle this. There might not be a record of it. Also lighting a building on fire is pretty serious and might be a deterrent to you getting your permit. Granted it was a long time ago so hopefully they can parse that and give you your permit but that would be a felony and any felony will preclude you from getting your permit. Maybe call a lawyer to see if they can have access to your file and advise you.

I always recommend speaking to an attorney familiar with New York pistol license matters. You will need to list every single arrest. Get all the court documents. I asked the town court clerk and she said she has nothing on file. And as I paid for an unsuppressed background check. According to NY dcjs it would have been listed. Thanks again.

So did they lose the arrest card? Was it never there? Is it sealed and on the record. I’m not sure if an unsurpressed background check would show sealed juvenile records or not. The clerk could have lost the card, not really looked, or may have not been truthful. I’d have to think he/she looked but all the above are possibilities. If the NYSP call they will look and if it’s there you’re in a denial and appeal situation. I agree and simply just make a quick call to an attorney to have them get the background check done and ensure it’s not there and not hidden from the check you did.I hear what you're saying. The dilemma your in is the exact you they want you to be in. For the arson thing did you ever go to court or was it a simple handcuff and take you to the station for your dad to pick you up? Those two things are vastly different IMO. Hicock and I have the same thoughts and advice so that’s what I would do. I’m not saying I’m the end all be all and right all the time but I have no clue if an unsupressed record check will show sealed juvenile records. Good news brother. I just was not sure if juvenile sealed records would be included. If they are you should be good to go.So an update. I have been emailing the DCJS about my unsuppressed report. The person on the other end told me EVERYTHING about my criminal history is on the report.
Including if there were sealed juvenile, family court. So it seems that little incident in 85 was kept off the books. I'm still gonna consult an attorney but I feel 100% confident I have my complete criminal report in hands.

I would believe that information will be microfiche in a Police Department archives. Many pistol license applications are denied because of a sealed conviction. You definitely should use an attorney since you have an arrest. When you apply here in New York for a pistol license. It’s a more thorough investigation.
