That case is funny. No probable cause that a crime has even been committed and they come busting in. One of these days, one of these raids will turn into a blood bath.
Doing things the right way takes too long and it's too hard.. I suppose.

GOOD, its about time these storm troopers dont get to hide behind qualified immunity. i hope it opens the door for tons of lawsuits that eventually force these types of raids to cease. unless there is someones life in immediate danger there is no reason for these kinds of tactics. now we gotta do away with no knock warrants.

I'm not great with math, but... the number of lawsuits that turn out well (like this one) vs. the ones with terrible outcomes (SAFE), plus the number of crazy new laws being passed is too unbalanced. Either things will get ugly in a bloody way, or things will get ugly in a we-have-no-freedoms way.

Total agreement about the personal liability.

Thanks for posting Hardrada. I've been saying we're all Unconvicted Felons for a while now. With all the laws and regulations on the books, the government can effectively end any one of us whenever it chooses. That's not the kind of power any of us want the government to have.

Several barbers who had been working were patted down, then handcuffed. When one of them, Reginald Trammon, protested that he had done nothing wrong, an officer replied, "It's a pretty big book and I'm sure I can find something in there to take you to jail for."

Shades of Lavrenti Beria's pledge to Stalin,
"Find me the man and I'll find you the crime."
Individual court victories against government officials who ignore the Constitution while lording their power over hapless Americans are heartening, but they can't cure the underlying malady. That malady is our abundance of needless laws that invite abuse by those who love to exert power.

Hopefully liability extends to those who give the orders, not the just the workers who may be presented with information which makes it appear that they are participating in a legal action. Policing went downhill when politicians and leaders staked their fortunes on creating abnormally low crime rates. Attempting to push crime below the levels dictated by human nature creates a situation where proactive enforcement is forced to discourage crime, rather than merely react to it as it arises.

Judges who sign warrants for BS should also be held accountable.

I'd love it if liability extended all the way to the top where applicable. Wouldn't it be great if Cuomo and his minions who passed SAFE were held personally accountable for a SAFE firearms raid?

Judges will never be held accountable, the buck will always stop with them. Short of the guillotines being dusted off that is.

The best way to lower the crime rate would be to eliminate all the unconstitutional and irrational laws. If it's not illegal then it's not a crime.

Imagine what would happen to the crime rate if drug possession were legalized ? I bet better than 50% of the crimes around here are mere possession.

california just turned loose 15000 low level drug possession cases that emptied out some of the over crowed prisons . So they are doing something but I know it's not fast enough for some people . On the topic it's about time someone in the up offices are responsible for these over blown raids they are doing with the stromtrooper mentality that has gotten to s one of the PD,s in these states . I think it has a lot to do with all of the " free stuff " the DOD is handing out now for Obama,s civilian police force that is as powerful as the military ! That's my 2 cts .
