Hello from California. Like New Yorkers, I live in a strict gun state, or the strictest in the nation and I thought I join a forum like this. Anyways, here's the story. On April 15, 2012, someone was walking our dog. It was being leashed. It was just 100 feet from being home. But it was attacked by 2 vicious dogs. The dogs roamed free down our street. The dogs killed our dog and took off with it. I'm not a dog guy nor do I know names of breeds and such, but our dog was no more than 16 inches tall. It's sort of like a miniature K-9 dog. It was attacked by 2 dogs 5 times as big by pitbulls I think.We call animal control, but I walk out in the general direction the dogs went before animal control came to scope things out. I found a witness saying he saw some dogs at the street corner near him. I'll talk to him later for details. Nothing came about Sunday.

I posted up signs the next day to see reactions. On Tuesday, I walked with my mom to see the dogs that might have attacked my dog. We stop by a house that my mom says she had problems walking by. We stop in front of the house and she claims that those were the 2 dogs that attacked our dog. My mom and I are there for no more than a minute talking on the sidewalk and the 3 people come out asking if we need something. I ask about their dogs. They claim that they never let out their dogs. (I assume that's why they acted the way they did - killed my dog). The young man says he claims to have taken it to the vet that day (bingo!). I look at the dogs through the cracks of the metal fence from the sidewalk. Identifiable.

They do match the dogs I saw on our security cameras. Yes, I have security cameras that caught the whole thing. But the video is a little grainy, but details of the dogs can be seen. I know those are the dogs. As I mentioned, I posted signs up on public mailboxes. In CA, we have public mailboxes where groups of neighbors go to get mail. I only posted on 1 side. My mom showed them which happened to be on the opposite side of their house so they never saw it until my mom showed them. So I went out last night to check their trash because I am certain they were the dogs because they had to throw away my dog. But I also notice my sign was taken down.

I called animal control about those dogs. If animal control doesn't do anything, what is my next steps towards a lawsuit, like small claims court. Our dog didn't deserve that. It was a good dog. I always thought of it was my 1st line of defense before my gun.

Edit: I'd like to add that since it's only no more than 16in high, it barked at strangers at the front door. So it was like a warning defense.

Also, I want those dogs put down. I could only imagine if my 2 1/2 year nephew was holding the leash which he did like. Those dogs don't belong alive.

if it was me, I would go to the police with video and ask them if that is enough evidence to support a warrant. If not, ask what else they need - whomever was walking this dog saw this happen, so there's a witness. Any other witnesses? How about neighbors in the neighborhood that could be character witnesses - people who will stand up and say "yes your honor, those appear to be vicious dogs, I don't care for them, i've heard/seem them doing X in the past", etc

If the law cannot do anything about it, unfortunately, legally, neither can you and then the next step is perhaps a lawyer who deals with this kind of thing

If you wanna go all vigilante, I cannot offer any advice

Even if you can't get the dogs put down, perhaps the owners can be tagged with a leash law, and then you become the dick neighbor that calls the police on them for EVERYTHING they do, til they can't take it anymore and move

double edit - what did animal control say when you called them?

You could burn their house down, kill them and their dogs, and hang all of their heads from a tree in your front yard as a warning to others. Just don't kill them with your gun.

First thing will probably be to file a formal complaint at the police office. I am not lawyer to the best thing is to hire a legal counsel. He will tell you what to do and seek compensation. Loose dogs are not allowed in cities let alone killer ones. They will be put down.

Call the police if that actually happened. They're better than an internet forum over 3,000 miles away.

By your response I take it you're calling BS on this post. If that's the case, I happen to agree with you. However, IMO your sarcasm is just playing into what the antis want to see posted on a gun forum. Better off just letting sleeping dogs lie as they are.

Good point because in the end, what could have been maybe never was, and who might be perhaps it isn't and you know we need to stay away from all sort of trolls, guns thrill chasing wackos as much as frustrated anti everything radical politicians.

"Somebody" was walking his dog when it happened; yet police we're not called. 3. "Not a dog person" and doesn't know breed of own dog. 4. His dog as 16"; others were 5 times as big (80" dog, I'd be scared). 5. Security cameras caught it all on tape but its a little grainy. 6. After killing dog, the others made off with the evidence. 7. Checked the garbage from neighbors with Pit Bulls. Come on people, if it looks like a duck and sounds like a duck...

I think you might be right. .... someone was walking the dog... then it was my mom.... police no called ..... humm

I'm waiting for the part where he has 25 million in Nigerian dollars for us and just needs our bank account numbers for the transfer. Don't scare him off until we get our money guys.

Putting it that way makes me a little suspicious, too. Especially since just a little google on the OP's topic would bring up the two most popular legal websites where questions like that are routinely discussed every day:
