Florida resident driving through New York State

Hi Guys,

The wife and I are planning a road trip from Florida to Maine and back. The issue is that we must drive through NYS that is not handgun friendly to residents of other states.

I have a Florida CWP by the way and I am a law abiding citizen And I want to bring along either a Glock 43x or a S&W model 60 .357.

Does NYS LE honor FOPA? (Firearm Owners' Protection Act of 1968)

Does anyone have any experience in this type scenario?

I have been scouring the internet but have found answers that the State Police will be waiting for me at the border to it's 100% legal, no problem.

I would be driving straight through New York State from Pennsylvania to Vermont.

Any info would be appreciated.

NYS has to honor the federal law and its best to have that printed out and with you in case you’re stopped. The troopers might be waiting there doing a speed trap but they will have no clue you have a firearm with you or not. You will not be stopped and arrested at the boarder because they won’t know you’re armed.

What I would say is no matter what you bring with you make sure it has a 10 round mag or less because simply possessing anything above 10 rounds is a felony in NYS. Also make sure the gun is unloaded and the gun is locked up while traveling through NYS. If not and you are stopped you will surely be arrested. As indicated do not spend the night in NYS and follow all traffic laws to avoid being pulled over.
Make certain anything gun or gun related is locked up and out of sight and NYS is not a duty to inform state so you do not have to tell an officer a gun is in the vehicle if you’re stopped. Know your rights and know that you can refuse to allow a search of your vehicle under most circumstances. Enjoy your vacation and you should be fine as long as you follow federal transportation laws regarding firearms.
They did just announce that they arrested a trucker for having a pistol in his door when he was forced to stop at a truck check stop so if you’re not following the federal laws you will be arrested.

Federal Standard is supported. No matter what, prior to you hitting the NYS boarder, stop/ unload/ put gun in lock box outside of your control/ ammo in separate area. If asked "I did not plan to stop and stay over night.". It is the supported an d legal standard. Things that get people in trouble; Not unloading/ putting in locked box outside of your control, saying you were going to spend the night in NYS. The troopers (at least in Northern NY) HATE having to take them away for these small mistakes. They really do.

I would even go a step further, and field strip your handguns especially if you don't have a trunk to secure your cased and locked firearms in, such as when traveling in a SUV.

One more thing, avoid NY City, they seem to think NY and Federal laws do not apply there and it will delay your trip and cost you money to fight them.

All the suggestions here are 100% accurate. My wife and I travel to Florida from NY. My suggestion is to take Interstates 75 to 40, to 81 to 84 going North and the opposite going back. This will keep you out of New Jersey, and you only travel 10 miles through Maryland (another very gun UNFRIENDLY state) Keep a copy of the Federal law with you and stay away from NJ. The route I just described will keep you out of there. I would also fill up with gas before you enter NY, and as all stated, drive carefully and you won't have any problems. I go onto Handgunlaw.us and print out the first page for each state I will go through. The first page basically summarizes each states laws. Also just scroll through each state and familiarize yourself with the basic rules. The farther North you go, the worse most states are, but no one is going to be waiting for you at the borders. This sucks that you need to do this to exercise your 2nd amendment rights, but this is the safest way to go. Each state has different laws, as I am sure you already know. Have a great trip!!

A story of a Florida man being hassled in Maryland because the officer was able to run his plate and get the data on him. This story was crazy. Family driving through, the cop see’s the Florida tag and decided to start following them. The driver had a Florida Pistol Permit. The cop was all over him about the pistol.

I heard a version of that one. The one I heard was the cop overheard the guys wife ask him if he had his gun with him. The cop supposedly made him empty the car looking for a firearm that the man didn't have. I'm not sure if it's true or not, HOWEVER, according to Handgunlaw.us or USCCA (I don't remember which) Maryland has stationary cameras that can take your plate number and come back with ALL your information. This is why I drive the bare minimum number of miles through that state. If it weren't so long to go around, I wouldn't go through there at all. I have a folder with all the updated gun regs for every state I go through, or even MIGHT go through, along with the Federal law allowing transportation or a firearm through any state. I would have the carry insurance through USCCA but in The Peoples Republic of New York, they are not allowed to sell me the carry insurance. This state is as corrupt as a state can get, and since it is 2 - 1 Dem over Rep, we are screwed.

I traveled to North Carolina a while back and when I looked at the route on my phone I didn’t realize we were going to head through Maryland, but we did. It was only for like 10-15 minutes but I had no issues and no cops were waiting for me.

That sounds like the route we take. Route 81 goes through 10 miles of Maryland. We've made the trip many times, and so far no issues. I just watch my speed.. It's bad that we need to pretty much sneak around for something that is our God given right!!
