That is the problem, sounds nice in theory for those that do not understand the US Constitution, but the whole "he said, she said" thing could really get out of hand.

po'd wives ? also inlaws...anyone in the family with a boner for an individual......can't express an opinion or get upset...or "thought" as "moody". Depressed because you don't hit on a sister in law or brother in law ,if female. Alot of scary scenario's. The author's of this bill, of course, are seeing it work in the "purist" way. Good luck with that.

"Under the California bill, whoever seeks the restraining order would have to sign an affidavit under oath. If they lie, they could be charged with a misdemeanor."

It is better than NY - if a health care professional decides you are a threat, no guns for you. They do not have to swear under oath, and you get no say in the matter. It would not matter if they took an oath anyway, since they are explicitly given immunity from civil penalties.

So all it takes is a "concern" of a family member and the swat team is kicking your front door in at 5am.

no, your brother/sister/father/mother/wife will let them in when they knock on the door

this is why the Second Amendment says "shall not be infringed". we cannot allow legislators to dictate how and when we exercise constitutionally protected rights! there are already more than 20,000 gun related laws in existence today, that is insane considering it is a protected right.

Quick new flash it already happens here in NY. If an order is issued against you ( for any reason) you must surrender your weapons until the order is dismissed or ended. I was told it is a federal law that affects every state. My attorney confirmed this is reality.
