I ordered 2 magazines for a S+W Bodyguard .380 in late March of 2011. A week later, when I called to check on the order since I hadn't been sent a shipping estimate I was told the item was back-ordered.
I asked how long they were back-ordered and was informed that "We do not foresee this item coming back into stock." Then I asked if the item had been back-ordered before I placed my order. The answer was "Yes."
I have called several times to check on status and have been told that the back-order status is permanent.
So to recap:

BoTach Tactical knowingly advertised (and is still advertising) a product for sale that they DO NOT actually have for sale.
They accepted my money and completed the sale of this product that they DO NOT actually have.
They have now informed me after my persistent calling for updates that the product WILL NOT be available in the future.
Quite simply: They took my money and gave me nothing in return.

HOW IS THIS NOT FRAUD?

Call the NYS Attorney General, let them know what happened. That will get there attention.

Did you get your money back? That'll be the difference between fraud and just having ****ty inventory/logistics.

Shouldn't of bought from them. :wacko: A known shady shady scheming outfit. A google search on page 1 would of shown you to avoid them.
That said I hope it works out for you. As mentioned above, contact the AG. Good luck and be sure to post updates.

They are ass*oles and never stock anything and give you false hope about availability when you ask. I have a Magpul sling on b/o from a year ago!

Stop checking on "the status of the order" and cancel the order.
That's the first thing the AG is going to tell you to do. Then, if they don't refund the money, call the AG.

I have the same problem w/ SWA....after a few emails they finally updated their site to reflect inventory.

Ordered several times from them, once the item was back-ordered, I asked how long they said two weeks I got the item in 3. No complaints here.

you had an issue a year and 4 months ago and are complaining about it now here?...Did you ever get a refund or the product?

I've ordered from them, the next morning they emailed me and said it would be backordered for approx. 2 weeks, got it in about a week and a half.

i have made a few orders with them with no problems. my first question is did you ever attempt to cancel it and get a refund or are you just telling us they took your money because you never tried? i would never have waited that long for a backordered item. a month tops and i would had it refunded and pay a little extra to deal with someone else.

wow I thought I was probably not the only one, just wanted to get some awareness out there but it seems like for the most part this is regular practice. That's a shame.
BTW - I haven't cancelled the order yet ( I was buying the mags as a present and got them direct from S+W once I was told that they were backordered)
Since they are apparently in short supply I thought it may be wise to hold out and give them a chance to come back into stock but at this point I'm giving up.

Seems to me you placed an order almost a year and a half ago, when informed they did not see it being in stock in the near future you decided to keep the back order (not cancel). You still have an open back order with them.

Your only valid complaint I can see is that you were not notified immediately that the item is back ordered.

EDIT: If they give you a hard time about calling off the order or refunding your money then I can also see a valid complaint, but until you tell them you want to cancel instead of telling them you want to keep waiting seems like your time would be better spent watching the grass grow then being upset they haven't sent you something they claimed will not be in stock in the near future.

I just ordered from them last Friday and the item arrived yesterday. Excellent price and superb shipping time. I would buy from them again.

They're not my 1st choice. The first order went fine. The second order I paid with PP. I received an order confirmation, then a shipping confirmation with tracking, a PP notification of accout charged, a PP refund, then a back order notice. Seems like a F'd up outfit to me so the order was cancelled and replaced to Brownells.
