    Default Ulster County at it again

    Ulster County is now a restricted Permit only County.
    1- The new Judge requires you to have a basic safety course taken after you submit your application. ( I do agree with this)
    2- All applicant now have to have a personal interview with the Judge ( I can see that)

    In the past two weeks I have had two friends go to the interview. Both times the Judge was not even there, nowhere around actually. The paperwork was all filled out already for a restricted permit. The interview was held both times by the Law Clerk.
    These citizens were not allowed to plead their case in a court of Law to a Judge. They were refused the right to submit evidence or proof to show cause that they might actually have a true and honest need for a carry permit. The rights of Ulster County Citizens are being trampled on.

    To be treated like this makes my blood boil!!! I give up on this county.
    I don't even know what to think or do anymore with the officials around here anymore.
    From the local cops, DEP Police, the Lawyers, the Judge's (Supreme and Family),,,Ulster County is a "Do as I say, Not as I Do" mentality and not a single part of it follows the LAW.
    You could slap people all day long in the face in this county with the Constitution and not a single one of them would know what it is.

    If ANYONE knows of decent gun rights lawyer, please let me know. I don't want this to be easy on any official in Ulster County.
    I will NOT bow down to their politics or childlike antics.

    I have to say reading things like that makes me glad I live where I do I had no interviews no hassle and recieved my permit in 2 months unrestricted. sorry to hear about your county, I wish your friends luckS

    I think it will take everyone standing up and shouting as one voice come election time that we are all tired of being pushed around by the people "We" elect.

    Sorry to hear your story, is it possible for the restrictions on the permit to be removed at a later date? I know of folk in Sullivan county that were initially issued a restricted permit by the judge only to have it removed 6 months by application. I am fortunate in that I caught the judge on a good day and was issued a full unrestricted permit, I think the other two who were being interviewed did also, Sullivan county has a pro gun judge, move here ;D

    One More Time; A judge issuing permits is not acting as a Judge under NY Law. That person is acting as an administrator, outside of the protections affrded Judges. Sue him personally and watch the fun begin. The County won't foot the bill for the Administrator's actions.

    Default Interview With The Judge

    I finally had my interview with Ulster County Judge Schneer last week, and yes I actually had an interview with the judge, in the courtroom, with other applicants, police officers, and some attorneys present in the courtroom. It doesn't get much more formal than this, and somewhat intimidating. Having said that, I am actually surprised and glad that the Judge is taking this serious because I think putting a deadly weapon in someone's hand is serious business.

    So if you're anticipating trying to get your CCW in Ulster County, here's what you can expect:

    1) You'll be sworn in, similar to testifying in a legal matter.
    2) The Judge will ask you your name and address, who you are living with, some basic employment history, why you want a CCW permit, and any training or experience you have with using firearms.
    3) If you have some past legal issues, even if they are 20+ years old, they may come up so be prepared to discuss them.
    4) Since I was requesting an unrestricted license, the judge asked me about my understanding of (paraphrasing) "rules of engagement". I think this is an important question as there have been some immature and irresponsible folks recently in our area that have brandished weapons or flashed them in an intimidating manner for dumb reasons (road rage, etc.). Reminder: CCW stands for Carrying a CONCEALED weapon. No one should know you are "packing heat" except the unfortunate individual(s) who may attempt to take your life.

    This type of behavior hurts all of the responsible CCW applicants and gun owners, and in my opinion:
    - If you have a short temper you should NOT be carrying a handgun.
    - If you are irresponsible, a slacker, or abusive you should NOT be carrying a handgun.
    - If you are a bully you should NOT be carrying a handgun.

    5) Lastly, the Judge mentioned a great point/question I had not thought of, namely that by carrying a firearm, if you are disarmed by someone, this weapon could be used either against you or in a subsequent crime, and asked me how (paraphrasing) I planned on dealing with this risk. Notice that I am not stating the answers I gave, as these are unique to my situation as will be yours. The judge then stated I would be receiving a decision in the mail.

    All in all I thought this process was appropriate. Be sure to be courteous and respectful to the Judge, and address him/her as "your Honor" in your responses to your questions.

    A final item for all CCW holders to consider: The likelyhood of actually having to use a handgun out in public to defend yourself or your family is about the same as hitting the lottery. There are some Police officers that never have to unholster their weapon in an entire career. And I think down deep all of us hope we never have to use our weapon to harm another person. However - IF it does happen - you need to be very sensitive to what is behind your target, or behind the wall that is behind your target. More than likely your bullet is going to pass through your target and continue on it's merry way at high velocity. This could result in the serious injury or death of other INNOCENT men, women or children. I don't think any of us want that.

    So bullet penetration and richochet awareness are crucial. This may be the last thing on your mind if this situation occurs with all the adrenaline rushing through your body and your heart pounding, but it needs to be an important consideration. JHP type bullets are safer in this regard. Avoid Glaser Safety Slugs except for in-home defense. I hope you consider doing this. You may save an innocent life or lives, maybe someone you know or love, by doing this and by being aware of all of this.

    Thanks JayRoe! I live right here in Ulster, and and no quite sure how this new procedure is going to work out. I believe that if there is no GOOD reason not to have a firearm, that you should not be restricted.

    Of course a lot of counties are going requiring some form of handgun education which incorporates state and local laws, and I AM however a big fan of this...

    If your going to carry, I feel that this is part of being responsible...

    Jay Roe let us know what happend on the decision, When I first moved to NYS after retireing, & having held a NYC CCWP for over 30 yrs due to the nature of my job back then, I had to go before the judge here in my county, one on one, & he had my file on his desk, & he knew more about me than I relized My military backround, as well as the nature of my job in NYC & we spoke for about 5 min, & I was issued my Non restricted CCWP right on the spot, even though I had no doubt that he wouldn't, because of my backround etc. I wish that it was that easy for everyone, who wanted one to protect themselves & their loved ones, according to our 2nd ammenmend God given right's
