If you have a california Drivers license can you purchase a rifle in new york state? From gun store and Individual? let me know please newbie. Thanks for the input so here: I haven't change my Driver license to ny state yet, since i still have property in California I come here and there back and forth when ever. Just for clarification if some of the gun store around will sell a rifles to out of state drivers license does this means that its unlawful? They run you a 4473 back ground check during purchase though. A driver’s license or an identification card issued by a State in place of a license is acceptable. |

Actually I had a brain fart. A Long gun purchase out of your state of residence is OK as long as it's legal in NY and CA. ATF Online - Firearms - Frequently Asked Questions - Unlicensed Persons Q: From whom may an unlicensed person acquire a firearm under the GCA? A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes. [18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30]

| Does it have to be a DMV id or could he get away with another form of state issued photo ID that had his NYS address on it? Here in Broome County we can get Sheriff's IDs from the same department that handles pistol permits. They are supposedly good enough to use to get on an airplane, I wonder if you could also use them to buy a gun?
