I wish they still did. It's getting freaking ridiculous in Washington. These guys aren't even pretending to try to obey the constitution (and their oath of office) anymore. Obama was supposed to be some sort of constitutional law professor yet he and his administration are hell bent on completely trampling on the constitution. The whole lot of them should be facing at least the kind of charges that any of us would face for breaking a federal law.

Stories like this make me want to cry. What in the hell is happening to us as a nation? Why is no one stepping up and control these American haters. Have we really become a Country full of sheep, a country of cowards? Where are the checks and balances that are supposed to be in place? Just sickening!

Chicago pols make up their own rules and a small thing like the Constitution does not present a big road block to these thugs.... The Supreme Court holds that international law is more important than US law, so that is where dear Eric got the idea.....
Not saying he hasn't, wouldn't, or won't, but I cant find a legit source to confirm this. Don't all lawsuits filed with the Supreme Court appear on some list?

Oath Keepers should be all over this. My oath was to the Constitution, not the UN and its treaties that they might have agreed to. My inalienable rights endowed by The Creator cannot be taken from me by a tyrannical government.
Hey ..... the writing was on the wall since 1961. People have chosen to be passive and allow this govt to do whatever it wants. Don't think of changing things now. I don't care WHAT the Constitution says about treaties .... it also says the govt is of the people and FOR the people .... it is not and as such, the govt itself is unconstitutional AND any treaties it engages in are NON BINDING!! It is time to either have a vote to remove Washington D.C., it's politicians, the govt of which it harbors and all that it stands for, from the Republic or find other means to be heard since they haven't listened to the American citizens in YEARS!!

Personally, I think that this should/will be an issue in the 2014 elections. Do Americans really want to continue with the progressive agenda and make The United States of America subservient to The United Nations? Obviously this administration believes that The UN functions on higher moral grounds than the US. One Obama appointed SCOTUS judge has already stated that the Constitution of South Africa is a better model than The Constition of The United Stated. Where so we want to go?

The key point in Reid v Covert:
The Court found: "No agreement with a foreign nation can confer power on the Congress, or on any other branch of Government, which is free from the restraints of the Constitution." The Court's core holding of the case is that U.S. Citizen civilians abroad have the right to Fifth Amendment and Sixth Amendment constitutional protections."
Thus Osama cannot use the UN Arms Treaty to supercede the 2nd Amendment. The Government must act within the bounds of the Constitution in any aspect of treaty interpretation. It cannot use treaties to gain power not granted by the Constitution.

However, digging a little further, it was apparently already decided in 1920 that Congress could go "beyond its authority" via a treaty. This case is re-testing that.
"Bond v. United States is back before the U.S. Supreme Court, and this time it raises a question that has long interested academics: What are the limits on Congress's power to implement treaties? Missouri v. Holland, decided in 1920, held that Congress could enact legislation implementing a treaty even if such legislation was otherwise outside the scope of its Article I, Section 8 authority. The decision is now canonical, and it has been widely accepted by most academics and followed by courts. Then, in a 2005 article in the Harvard Law Review, Professor Nicholas Quinn Rosenkranz challenged Missouri v. Holland's rationale and asserted that it should be overruled. His arguments are now front and center before the Court in Bond."
Most likely Holder is seeking to maintain status quo.
That said (IANAL) I think Congress going "beyond its authority" is an entirely different beast than Congress "using a treaty to strike down a provision of the Constitution". Doing things you weren't authorized to do is one thing (and I hope it is reversed), but even if it isn't, I don't think they could do something they were explicitly prohibited from doing, i.e., via 2A.
There may be (somewhat) less to worry about than it would first seem. Real lawyer thoughts?
I draw a distinction between directly contradicting the tenets of the Constitution (specifically its supremacy) and adopting treaties that generally exceed Congress's authority. While such an attempt at an end-run around 2A would be characteristic of Holder, I can't see how there is a legal basis for it.
Is it just me or does everyone think the DOJ has become summer over the past 30 years? Someone had better check to see if their coffee cups are coated with lead paint.
There are going to be severe repercussions (for us as a nation) if the Supreme Court rules against the constitution...again.
