    Default denied for purchase

    I am an avid hunter and shooter. I tried to buy a shootgun for my 12 year old son and was denied. The F.B.I (N.I.C.S) states "either you or another individual with similar nameand / or similar descriptive features" is a fugitive from justice. They want me to submit finger prints. Should I get a lawyer for this or just do it????

    So have you called them or contacted them out side of the initial check yet? If not I would recommend doing that first. The system is in place to prevent the wrong person from gaining access to a firearm. I see no reason to call a lawyer, They are doing what the system was set up to do. Oh and after this is said and done you can get in touch with them and get your own "card ID number" and you will always get a "yes" response in the future. Think of it as the express check out lane.

    Calling a lawyer to even have him look at this will cost more than most high-end shotguns.
    I don't understand why you're first thought would be to lawyer up, you're not being charged with anything. Do what bpipe95 said and talk to the Feds directly. They are not trying to screw you, they are doing their job, keeping gun sales safe. This happens more than you may think and I'm sure it's not too bad of a process. And if it requires fingerprints, that sucks but, if you have a pistol permit you've given them once before.

    Out of curiosity did you supply your SSN when doing the ATF paperwork? I very rarely give mine out but on the form it states "optional but will help to prevent misidentification". I provided it because my biological father was dishonorably discharged from the service, has a criminal record and I unfortunately share his name. Was worried about a denial or hold because of this but I was approved over the phone and didn't have any issues.

    I KNOW A GUY THAT JUST WENT THRU THIS CRAP.HE WAS ARRESTED FOR A B.S.
    MISDEMEANOR 30 YRS. AGO.WELL HE JUST TRIED TO BUY LONG GUN AND WAS DENIED.
    HE HAS BEEN BUYING GUNS FOR THE LAST 30 YRS.WITHOUT A PROBLEM UNTIL 4 MONTHS
    AGO. HE FILLED OUT A FORM AND SENT IT TO THE FBI AND THEY SENT HIM A FINGERPRINT CARD AND SOME OTHER FORMS TO FILL OUT AND SEND BACK TO THEM.WELL AFTER ABOUT 2 MONTHS HE GOT A REPLY BACK THAT HIS B.S. MISDEMEANOR
    ARREST WAS THE REASON HE WAS DENIED. COME TO FIND OUT THE DUMBASS LIBERALS
    IN THIS STATE PASSED A LAW THAT CERTAIN MISDEMEANORS IN N.Y. ARE NOW REASONS FOR DENIALS. NO NEED FOR A LAWYER JUST PAY THE 15.00 OR 20.00 FOR THE
    COPS TO FINGERPRINT YOU AND SEE WHAT THEIR REASON IS. THIS GUY I KNOW WAS TOLD THAT HE HAD TO GET A CERTIFICATE OF GOOD BEHAVIOR FROM THE TROOPERS
    AND FILL IT OUT AND ONCE THEY HAVE IT BACK IT WILL TAKE 2 MONTHS BEFORE YOU CAN START BUYING LONG GUNS.HE DOES"NT HAVE ANY HANDGUNS BUT IF YOU DO YOU BETTER TALK TO SOMEONE BEFORE YOU GET THAT CERTIFICATE. BECAUSE I THINK SOMEONE TOLD HIM HE COULD NOT OWN ANY HANDGUNS. IF YOU TURN IN THAT CERTIFICATE YOU BETTER CHECK FIRST BECAUSE IF THEY START DIGGING DEEPER THEY

    Cops don't know the laws, they just enforce them. If you really have something you're worried about you talk to a lawyer. If you've got nothing to worry about, just do what they ask.

    There's been no mention of Police. As I understande it the gunstore just said that the Feds would not allow the sale to be completed with the information provided.

    Telling someone to go to a cop for legal advice is not a good idea. Sure they know a lot about laws, but the things they know a lot about are the things that they deal with on a daily basis (search procedure, evidence admittance, etc). There's a heck of a lot they don't know and I've known cops to give out advice that was contrary to what the actual law says.

    +1 on this - don't ask a LEO about the substance of the law - he/she knows the 'tactical applications' of the law and these (alone) will get the average citizen in trouble rather quickly. Talk to a lawyer - they're paid to know the laws and how they're administered......
