Default getting hassled by the man..

I have a question for all you NY Firearms people.

~ Have you ever been to the range and actually have a police officer or an ATF agent come to you and start finger fucking your guns to see if they were legal?

Nope i have never been talked to or anything, it just makes me wonder how likely it is for people to get caught with bad things if no one is checking ranges.

I heard that Sleepr56 was cavity searched one time by a 300lb DEC officer, and let me tell you, she wasn't gentle. Other than that, nothing as far as I know.

I've shot a couple of times when a LEO was present but they never even looked at the guns. Just said hi to everyone and hung out for a while.

Well at least it wasn't a 'he' who did the search.

Josh, make your guns legal, then it won't be a concern.

Coppers don't care about guns as much as you think. I got pulled over once and the cop asked if I had any guns, and I said I had one in my trunk and I had ammo in the front seat. He just asked if it was registered, I said yes, and that was it! He didn't seem to care past that.

Most ranges are private property, so how would law enforcement go about "checking" them unless they were invited in by the owners/governing body or obtained a warrant? I'm not aware of a gun club exception to the 4th amendment.

I wouldn't take this as a license to break the various NYS laws regulating firearms though. Your odds of getting caught with that post-ban magazine may be low but a Class D felony is nothing to sneeze at. It's not a speeding ticket we're talking about here. If caught and convicted you'll lose your gun ownership (and voting?) rights for the rest of your life.

I thought the constitution only applied to public entities?

Like, you know, if you come into my house, I can tell you to shut up and revoke your first amendment rights, because I'm not the government, I'm a private entity, just like the gun range is.

That's true. But I guess I don't understand the connection to the topic at hand? The gun range isn't the entity that the thread starter asked about. He asked about law enforcement. Since most ranges are private entities it stands to reason that law enforcement can't go snooping around their property without permission or a warrant.

I know, but what I mean is if a cop says to the owner "hey, I want to check out this guy's rifle" the owner might say "hey, this cop wants to check your rifle and we're allowing him to." So, he wouldn't be checking it as a cop per say, but as a guy who was given permission by the clubs owner.

I could be totally off base here, I'm just thinking it might be the only possible way a cop could look at his gun without a warrant.

Yes, the owner could give them permission to come onto the property. I would think that the owner of the rifle could still decline to allow them to review it though. I don't forfeit my 4th amendment rights just because I'm on your land. You can ask me to leave but you can't compel me to let you or someone else rummage through my belongings.

It's the same theory with the big box stores that do bag checks. You are completely within your rights to decline the bag check and walk right out of there. I don't even break stride when they ask me if they can search through my bag. Just a curt "No, thank you." The store can ask you never to come back but they can't compel you to let them search through your property.

Now if you had a firearm out in the open and there was some obvious issue with it, the LEO could seize it under the plain view doctrine. The 4th amendment doesn't protect you if the incriminating object is in plain view.

Ah, ok, that makes sense then. I guess the moral is just to make sure your guns are within the law, or at the very least, appear as if they are.

You probably shouldn't discuss that you have "pmags" around here, on a public forum that everyone can see. I know darkvibe wouldn't appreciate it. If you have something like that, just keep it to yourself.
