I have a question for all you NY Firearms people. ~ Have you ever been to the range and actually have a police officer or an ATF agent come to you and start finger fucking your guns to see if they were legal? ~josh |

Coppers don't care about guns as much as you think. I got pulled over once and the cop asked if I had any guns, and I said I had one in my trunk and I had ammo in the front seat. He just asked if it was registered, I said yes, and that was it! He didn't seem to care past that.

| That's true. But I guess I don't understand the connection to the topic at hand? The gun range isn't the entity that the thread starter asked about. He asked about law enforcement. Since most ranges are private entities it stands to reason that law enforcement can't go snooping around their property without permission or a warrant.

I know, but what I mean is if a cop says to the owner "hey, I want to check out this guy's rifle" the owner might say "hey, this cop wants to check your rifle and we're allowing him to." So, he wouldn't be checking it as a cop per say, but as a guy who was given permission by the clubs owner. I could be totally off base here, I'm just thinking it might be the only possible way a cop could look at his gun without a warrant. |

Yes, the owner could give them permission to come onto the property. I would think that the owner of the rifle could still decline to allow them to review it though. I don't forfeit my 4th amendment rights just because I'm on your land. You can ask me to leave but you can't compel me to let you or someone else rummage through my belongings. It's the same theory with the big box stores that do bag checks. You are completely within your rights to decline the bag check and walk right out of there. I don't even break stride when they ask me if they can search through my bag. Just a curt "No, thank you." The store can ask you never to come back but they can't compel you to let them search through your property. Now if you had a firearm out in the open and there was some obvious issue with it, the LEO could seize it under the plain view doctrine. The 4th amendment doesn't protect you if the incriminating object is in plain view.

You probably shouldn't discuss that you have "pmags" around here, on a public forum that everyone can see. I know darkvibe wouldn't appreciate it. If you have something like that, just keep it to yourself.
