			<content:encoded><![CDATA[<p>If you bought a GSG-5 SD model rifle with a fake suppressor on it you should read this.  The ATF now says the fake can is regulated and must be replaced.  From what I can gather by reading online the SD model shroud is hollow whereas the smaller carbine shroud is solid with a hole drilled through it.</p>
<p><em>&#8220;To all retail customers: </em></p>
<p><em>On January 2010 American Tactical Imports Inc received official  notification from the Bureau of Alcohol, Tobacco, Firearms and  explosives that the original barrel shroud (aka: fake suppressor)  supplied with your GSG 5 SD model must be replaced. It has been  determined that this shroud is regulated under the National Firearms  Act. American Tactical will provide a replacement shroud at no charge  for each GSG 5 SD model sold or currently in inventory.</em></p>
<p><em>Consumers in possession of a GSG 5 SD model with the original shroud  in place on the firearm are now in violation of the NFA. To avoid  continued violation of the NFA, ATI asks that all persons in possession  obtain a replacement shroud as soon as possible. We anticipate arrival  of the new shrouds to begin by the middle of February 2010.</em></p>
<p><em><strong>IMPORTANT: </strong>THE ORIGINAL SD MODEL SHROUD MUST BE  RETURNED ACCOMPANIED BY THE FIREARM SERIAL NUMBER BEFORE A REPLACEMENT  SHROUD IS ISSUED. THE DIAMETER OF THE SD SHROUD IS 1-9/16&#8243;. DO NOT  RETURN THE SMALLER CARBINE SHROUD.</em></p>
<p><em><strong>WHAT TO DO:</strong><br />
If possible return your old shroud to the dealer where purchased and  show him this notice. The shroud will be returned to ATI along with a  list of serial numbers from the guns that the shrouds were removed. ATI  will send replacements to the dealer for pick up at your convenience;  ATI will be sending replacements as fast as logistics allow. If your  dealer is out of business or difficult to reach, or you purchased your  gun used, from a consumer, return the shroud directly by US mail or UPS  to American Tactical Imports Inc. 100 Airpark Drive Rochester, NY 14624.</em></p>

<p>I first found this info <a href="http://www.guntrustlawyer.com/2010/02/atf-says-atis-fake-suppressor.html">here</a> and a google search turned up the same info on many other site.  However, it does not appear on the ATI website so it&#8217;s probably best to contact ATI via email if you own one.</p>

			<content:encoded><![CDATA[<p>I was taken aback by an email I received today.  It included a proposal from SCOPE that supports renewable pistol licenses.  In the email SCOPE justifies the view by saying <em>&#8220;Based on the high probability of the passage of one or both of these bills, which we feel it is not realistic to blanketly oppose, we are working on proposals designed to protect our interests while meeting the stated objectives of the sponsors.&#8221; </em></p>
<p>Their proposal includes a 2 tier licensing system.  A possession license would require a 5 hour lecture which, according to the proposal, would cost $75 to $100.  This training is similar to the NRA first steps course.  An optional concealed carry permit would require 16 hours of training in defensive tactics and laws and according to the proposal would cost $150 to $200.  This training is similar to the NRA personal protection outside the home I, II and III.</p>
<p>Renewal fees would be limited to actual cost which would be under $50.</p>
<p>The proposal does include some good points such as a provision in the penal law to allow hands on training during the training and removal of the &#8220;proper cause&#8221; clause for issuing a permit.</p>
<p>I think this proposal creates unnecessary added costs to an already expensive application process.  It also adds more burden on licensing agencies that are already months behind and although permit holders will fund the renewals, it does not address funding the added cost of vetting candidates under the two tier system.  I don&#8217;t think this is a good starting point for a pro gun organization to accept regarding this legislation.  I would rather support NYSRPAs position of opposing any renewable pistol license legislation.</p>

			<content:encoded><![CDATA[<p>Kirsten Gillibrand&#8217;s website has a <a href="http://gillibrand.senate.gov/newsroom/press/release/?id=D7EB8730-4BCD-4D52-B86D-4682284D1CA2">press release</a> regarding proposed legislation to curb &#8220;illegal gun trafficking&#8221; into New York.  The press release has quotes from a lot of public officials in New York including the mayors of Rochester, Syracuse, Albany, Binghamton and Buffalo and Monroe County DA Mike Green.</p>
<p>Take a look at this <a href="http://www.snowflakesinhell.com/2009/11/24/gillibrands-gun-control-bill/">blog post</a> on the Snowflakes in Hell website which has a nice summary of their proposal with some thoughts on each point.</p>
<p>Yet another proposal that addresses actions that are already illegal and has as much gray area as any law we already have.</p>
<p>There are five main points described in the press release.</p>
<ol>
<li>The<em> Gun Trafficking Prevention Act </em>makes it illegal to traffic or assist in the trafficking of a firearm, making it unlawful to deliver or receive two or more firearms where the individual knows or has reason to believe that the firearms are being, or will be, used in a felony.</li>
<li>The legislation establishes stiff penalties that are a much-needed deterrent to gun trafficking.  Under this bill, traffickers could face up to twenty years in prison and be fined a significant sum of money.</li>
<li>The Attorney General of the United States and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) are empowered to impose heightened restrictions, levy tough financial penalties, and suspend or revoke the license of any corrupt gun dealer.</li>
<li>Provides ATF with the resources that it desperately needs to inspect all federally licensed gun dealers and further investigate high-risk gun dealers.</li>
<li>The legislation upholds the Constitution and protects the rights of law-abiding gun owners.  Specifically, the bill provides a defense for an individual seller who obtains a background check on the person to whom he or she is selling prior to the sale.</li>
</ol>
<p>It looks like #5 is a lame attempt to appease legal gun owners while not really accomplishing anything.</p>

			<content:encoded><![CDATA[<p>A Rockland County man surrendered 3 handguns, 3 rifles, a shotgun and shooting accessories to the sheriff&#8217;s department pursuant to a temporary order of protection as he went through a divorce in early 2002.  When he returned to claim his property in mid-2006 he learned that his property had been destroyed.  Last week the appellate division of the court overturned the previous judgement that the property had been legally destroyed.  In the decision the court ruled that the shotgun, rifles and shooting accessories were illegally destroyed because they were not considered &#8220;firearms&#8221; as defined in penal code 265.00.  The plaintiff conceded that the handguns were legally destroyed.  The decision also states that the Sheriff&#8217;s department is open to suit and not exempt by immunity because the department had a policy allowing illegal destruction of property.</p>
